Rental Policies (Summary)

  • Weekend rentals run from Friday pickup through Monday return.

  • A 50 percent non-refundable booking deposit is required to reserve your rental date.

  • The remaining balance is automatically charged prior to Friday pickup.

  • A refundable $150 security deposit is required prior to or at pickup.

  • Renters are responsible for loss, damage, missing items, excessive cleaning, or late return during the rental period.

  • Rentals are non-refundable due to weather or other conditions beyond our control.

  • All equipment is inspected at pickup and after return for completeness, cleanliness, and damage.

Full Rental Agreement

This Rental Agreement (“Agreement”) is entered into between Delta Breeze Party Rentals (“Owner”) and the undersigned individual or entity (“Renter”).

By signing this Agreement, Renter acknowledges that they have read, understood, and agree to all terms and conditions set forth below.

3. Rental Items Issued

The equipment rented (“Equipment”) consists of commercial-use party rental items, which may include folding tables, folding chairs, yard games, and Nerf-style recreational equipment with accessories.

All Equipment and quantities are documented on the rental checklist provided at pickup and incorporated into this Agreement.

Renter is responsible for returning all Equipment, accessories, and components, including but not limited to table legs, chair frames, game pieces, balls, darts, magazines, blasters, bins, and storage tubs, in the same quantity and comparable condition as received, normal wear excepted.

4. Rental Period

  • Pickup: Friday during the scheduled pickup window

  • Return: Monday during the scheduled return window

Pickup and return windows communicated by email or text are incorporated into and governed by this Agreement.

5. Payment Terms

  • A 50 percent (50%) non-refundable booking deposit is required at the time of booking to reserve the rental date.

  • The remaining rental balance will be automatically charged forty-eight (48) hours prior to the scheduled Friday pickup.

  • A refundable security deposit of $150 is required prior to or at pickup.

  • No equipment will be released unless all required payments have been completed in full.

All payments must be made by credit or debit card. Cash, checks, and peer-to-peer payment methods are not accepted.

6. Security Deposit and Inspection

The security deposit serves as protection against missing items, damage, excessive cleaning, or late return.

Owner shall have up to five (5) business days following return of the Equipment to inspect all items.

The security deposit will be released after inspection is completed, less any lawful deductions for loss, damage, excessive cleaning, or late return. If deductions are required, a partial refund may be issued along with a brief summary of the reason.

7. Condition at Pickup

Renter acknowledges that all Equipment is received in clean, safe, and functional condition unless otherwise documented at pickup.

Any defects or concerns must be reported at pickup. Failure to do so constitutes acceptance of condition.

8. Use, Supervision, and Responsibility

Renter assumes full responsibility for the Equipment from pickup through return, including responsibility for loss, theft, or damage, regardless of cause.

All Equipment is intended for recreational, non-commercial use only.

Equipment designed for children’s use, including yard games and Nerf-style equipment, must be used under adult supervision at all times.

Equipment may not be modified, altered, dismantled, or used in a manner inconsistent with its intended purpose.

Equipment may not be sub-rented, loaned, or relocated to another address without prior written approval from Owner.

9. Cleaning, Damage, and Loss

Equipment must be returned reasonably clean and free of food residue, grease, tape, gum, stickers, confetti, dirt, or adhesives.

Equipment returned excessively dirty or unsanitary may result in a minimum $50 cleaning fee, representing reasonable cleaning costs.

Scratches, scuffs, and minor cosmetic wear consistent with normal event use are considered normal wear.

Cracks, broken frames, bent legs, structural damage, burn marks, paint, permanent staining, missing hardware, missing accessories, or unusable components are not considered normal wear and will be charged accordingly.

Nerf Equipment and Accessories

Nerf-style rentals include multiple small components. Renter acknowledges responsibility for returning all darts, magazines, blasters, bins, and accessories included in the rental.

Missing Nerf components may be charged individually at reasonable replacement cost. The security deposit may be partially refunded to account for missing or damaged components.

10. Credit Card Authorization

By signing this Agreement, Renter authorizes Owner to retain the payment method on file and to charge that method for any amounts lawfully owed under this Agreement, including but not limited to:

  • Missing Equipment or components

  • Damage beyond normal wear

  • Cleaning fees

  • Late return fees

  • Replacement costs for unreturned Equipment

Charges may exceed the security deposit if necessary. Itemized charges will be provided upon request.

11. Late Returns

Equipment not returned by the agreed return time may incur a $25 per day late fee, representing reasonable loss of use.

Equipment not returned within seven (7) days of the scheduled return date may be deemed lost and charged at full fair market replacement cost.

12. Weather and Force Majeure

All rentals are non-refundable. Weather conditions, power outages, acts of God, government actions, or other events beyond Owner’s control do not qualify for cancellation or refund.

Owner does not guarantee usability of Equipment under adverse conditions.

13. Assumption of Risk and Release of Liability

Renter understands that use of tables, chairs, yard games, and Nerf-style recreational equipment involves inherent risks.

To the fullest extent permitted by California law, Renter voluntarily assumes all risks associated with possession and use of the Equipment and releases Owner from liability for injury, property damage, or loss arising from such use, except to the extent caused by Owner’s gross negligence or willful misconduct.

14. Indemnification

Renter agrees to indemnify and hold harmless Owner from any claims, damages, losses, or expenses, including reasonable attorney fees, arising from Renter’s possession, use, or control of the Equipment, except where prohibited by law.

15. Governing Law and Venue

This Agreement shall be governed by the laws of the State of California.

Any legal action arising from this Agreement shall be brought in the county in which Owner is principally located.

16. Duration of Agreement

This Agreement remains valid for 365 days from the date of signing and applies to all rentals by the same Renter during that period unless modified in writing.

17. Severability

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

18. Agreement Acceptance
